Terms of Service: My Window LLC

Company: My Window LLC, a Florida Limited Liability Company Application: Florida Outdoors Mobile Application (“App”)

1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and My Window LLC ("Company," "we," "us," or "our"), governing your access to, and use of, the App.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

2. ELIGIBILITY AND MINIMUM AGE

By using this App, you represent and warrant that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. If you are under the age of 18, you are not permitted to use the App.

3. DESCRIPTION OF SERVICES

The App is a directory and informational service providing:

  • Weather and condition information for outdoor activities.

  • A directory of third-party outdoor activity operators ("Operators").

  • Activity scoring and recommendations based on current conditions.

  • Links to Operator websites for booking purposes.

4. DIRECTORY SERVICE ONLY – NO BOOKING PLATFORM

IMPORTANT: THE APP IS A DIRECTORY AND INFORMATIONAL SERVICE ONLY. WE DO NOT PROCESS BOOKINGS, RESERVATIONS, OR PAYMENTS. When you contact or book services with an Operator:

  • You are entering into a direct agreement with the Operator, not My Window LLC.

  • All bookings, payments, cancellations, and refunds are handled directly by the Operator.

  • My Window LLC has no control over, and assumes no responsibility for, Operator services.

  • You are responsible for reviewing and agreeing to each Operator's individual terms and conditions.

5. WEATHER AND CONDITION INFORMATION DISCLAIMER

Weather data and activity scores are sourced from third-party services (including NOAA) and are FOR INFORMATIONAL PURPOSES ONLY. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY WEATHER OR CONDITION INFORMATION. You acknowledge and agree that:

  • Weather conditions can change rapidly and unpredictably.

  • Activity scores are algorithmic estimates, not safety guarantees.

  • You must independently verify conditions before participating in any activity.

  • You should always defer to local conditions, Operator guidance, and your own judgment.

6. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

OUTDOOR RECREATIONAL ACTIVITIES ARE INHERENTLY DANGEROUS AND CAN RESULT IN SERIOUS INJURY OR DEATH. By using this App, you acknowledge and voluntarily assume all risks associated with outdoor recreational activities, including but not limited to: drowning; marine life encounters (sharks, jellyfish, stingrays, etc.); weather-related hazards (lightning, heat exhaustion, hypothermia); equipment failure; boating accidents; and acts or omissions of Operators or other participants.

YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE My Window LLC, its members, managers, officers, employees, and affiliates from any and all liability, claims, or causes of action arising from or related to your use of the App or participation in any outdoor activity.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, My Window LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall the total liability of My Window LLC to you exceed the amount you paid to us, if any, for use of the App during the twelve (12) months prior to the claim.

8. INDEMNIFICATION

You agree to indemnify and hold harmless My Window LLC from and against any claims, damages, or expenses (including attorneys' fees) arising from your use of the App, your violation of these Terms, or your participation in any outdoor recreational activity.

9. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. We do not warrant that the App will be uninterrupted, error-free, or meet your requirements.

10. THIRD-PARTY OPERATORS

We do not endorse, guarantee, or assume responsibility for the accuracy of Operator information, the safety of Operator services, or any disputes between you and an Operator.

11. ACCEPTABLE USE

You agree not to use the App for unlawful purposes, transmit harmful code, scrape data without permission, or interfere with App servers.

12. INTELLECTUAL PROPERTY

All original content, features, and functionality are owned by My Window LLC and protected by copyright and trademark laws.

13. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Florida. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida.

14. DISPUTE RESOLUTION AND BINDING ARBITRATION

Any dispute arising out of these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

  • CLASS ACTION WAIVER: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

  • RIGHT TO OPT-OUT: You may opt out of this arbitration agreement by notifying the Company in writing at legal@mywindowllc.com within 30 days of first using the App. Include the subject line "ARBITRATION OPT-OUT."

15. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
